This study explores the intersection of international intellectual property law, data privacy regulation, and ethical AI governance in the context of AI-driven fintech innovations, particularly platforms like Payment-as-a-service (PaaS) and software-as-a-service (SaaS).The TRIPS Agreement under WTO lacks specific provisions for algorithmic technologies and artificial intelligence, for which fintech firms face fragmented protection across jurisdictions. Through a comparative legal analysis of India, US, and UK, this paper investigates how patentability standards, trade secret laws, and data privacy obligations interact with rapid innovation cycle seen in fintech companies. It evaluates the limitations of existing WTO/TRIPS frameworks in addressing the unique needs of software-driven financial products, and offers recommendations for ethical and transparent governance aligning to the intellectual property and data protection regimes with emerging AI technologies. The study concludes that while TRIPS provides a baseline for IP protection, it must evolve through domestic reforms, regulatory cooperation, and ethical AI frameworks to foster responsible innovation in global fintech ecosystems.
